Inappropriate Content:

• Include material that might impair the physical, mental or moral development of persons under the age of 18
• Express or imply that statements are endorsed by WAGER WISE without prior written consent
• Impersonate any person or entity, including WAGER WISE employees or representatives

Prohibited Submissions:

• Submit unlawful, fraudulent, libelous, defamatory, or objectionable content
• Submit non-public information about companies without authorization
• Submit advertisements, solicitations, chain letters, pyramid schemes, or other unsolicited commercial communication
• Submit harmful, obscene, pornographic, sexually explicit, indecent, lewd, violent, abusive, profane, insulting, threatening, harassing, or hateful material
• Submit material that harasses, victimizes, degrades, or intimidates individuals based on religion, race, ethnicity, sexual orientation, gender, age, or disability
• Use any password or code to participate in a presale or offer without receiving it from WAGER WISE or if violating presale terms

13. No text or data mining, or web scraping

You shall not conduct, facilitate, authorize or permit any text or data mining or web scraping in relation to our website or any services provided via, or in relation to, our website for any purpose, including the development, training, fine-tuning or validation of AI systems or models.

Prohibited Activities Include:

• Any "robot", "bot", "spider", "scraper" or other automated device, program, tool, algorithm, code, process, or methodology to access, obtain, copy, monitor or republish any portion of our website or any data, content, information, or services

23. Violation of these Terms

23.1 Investigation Rights

WAGER WISE MAY INVESTIGATE ANY VIOLATION OF THESE TERMS, INCLUDING UNAUTHORIZED USE OF THE WEBSITE. WAGER WISE MAY PROVIDE LAW ENFORCEMENT WITH INFORMATION THE USER PROVIDES TO WAGER WISE RELATED TO THE USER'S TRANSACTIONS TO ASSIST IN ANY INVESTIGATION OR PROSECUTION OF THE USER.

23.2 Legal Action

WAGER WISE MAY TAKE LEGAL ACTION THAT IT FEELS IS APPROPRIATE. THE USER AGREES THAT MONETARY DAMAGES MAY NOT PROVIDE WAGER WISE A SUFFICIENT REMEDY AND THAT WAGER WISE MAY PURSUE INJUNCTIVE OR OTHER RELIEF FOR THE USER'S VIOLATION OF THESE TERMS.

IF WAGER WISE DETERMINES THAT THE USER HAS VIOLATED THESE TERMS OR THE LAW, OR FOR ANY OTHER REASON OR FOR NO REASON, WAGER WISE MAY CANCEL THE USER ACCOUNT, AND PREVENT THE USER FROM ACCESSING THE WEBSITE AT ANY TIME WITHOUT NOTICE.

23.3 Account Termination

IF THAT HAPPENS, YOU MAY NO LONGER USE THE WEBSITE OR ANY CONTENT. YOU WILL STILL BE BOUND BY YOUR OBLIGATIONS UNDER THESE TERMS. YOU AGREE THAT WAGER WISE WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR TERMINATION OF YOUR USER ACCOUNT OR ACCESS TO THE WEBSITE AND WAGER WISE WILL NOT BE REQUIRED TO MAKE THE WEBSITE OR THE USER ACCOUNT OR ANY RELATED INFORMATION AVAILABLE TO YOU.

24. Dispute Resolution

24.1 Governing Law and Jurisdiction

General Jurisdiction:

Except as provided in paragraph 24.1.2, these Terms and your use of the Website shall be governed by and construed in accordance with the laws of the State of Delaware without regard to its conflicts of laws principles, in which case venue for any dispute may be appropriate in Delaware. We both hereby consent to the personal jurisdiction of the courts in and for the State of Delaware, as well as other appropriate jurisdictions.

UK Jurisdiction:

If you are accessing the Website from the United Kingdom, these Terms of Use, their subject matter, and their formation shall be governed by English law. We both agree to the exclusive jurisdiction of the English courts, except that if you are a resident of Northern Ireland, you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.

24.2 Jury Waiver

YOU ACKNOWLEDGE AND AGREE THAT BOTH YOU AND US ARE WAIVING THE RIGHT TO A TRIAL BY JURY IN ANY LITIGATION, MEDIATION, OR ARBITRATION PERTAINING TO THESE TERMS. ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ON AN INDIVIDUAL BASIS ONLY.

24.3 Class Action Waiver

It is agreed that any dispute resolution proceedings will be conducted on an individual basis only, and not in a class, consolidated, or representative action. Site users agree not to participate as a plaintiff or class member in any purported class, consolidated, or representative proceeding related to these Terms or the Website.
